FATstitution

Preamble

The FAT people proclaim their attachment to the Declaration of the Rights of FAT and the principles of sovereignty as defined by this FATstitution.

By virtue of these principles and that of the self-determination of monke, the Republic offers all those of the world that express the will to adhere to them a Republic founded on the common ideal of liberty, equality and faternity.

Article 1

The Monke’s Republic of FAT shall be an indivisible, secular, democratic and social Republic. It shall ensure the equality of all Fatizens before the law, without distinction of origin, race, religion or football club.

Section I - On Sovereignty

Article 2

The National Flag shall be a gold trimmed, Green, Black and Red triband with the Coat of Arms featuring Monke flip.

The motto of the Republic shall be We Never Eat, We Always FAT.

Its principle shall be: government by monke and for the monke.

Article 3

National sovereignty shall belong to the Fatizens who shall exercise it through their freedom of speech, emote and use of El Fatador.

All Fatizens of any origin, race, religion or football club who have reached Officer status may control Fatador by statute.

Suffrage may be direct or indirect as provided by the FATstitution according to rank and Officer status.

Fatizenship shall be available to anyone who has reached their eighteenth birthday and who has dedicated themselves to the principles set forth by this Constitution and the previously published Declaration of the Rights of FAT.

Section II - The Commander of the Republic

Article 4

The Commander of the Republic shall see that the FATstitution is observed. He shall ensure, by his arbitration, the proper functioning of the public authorities and the continuity of FAT.

He shall be the guarantor of the independence of FAT, its territorial integrity and the observance of all treaties.

Article 5

The Commander of the Republic shall be elected for a term of one hundred years through an election by The Council of Officers.

Article 6

The Council of Officers can forcibly remove the Commander of the Republic from power through a Coup Election.

Subsection 1

A Coup Election may be called by any Officer in FAT using the o7!coup  command. However, a Coup Election may only be called once every thirty days. Any officer who calls for a Coup Election prior to the expiry of this thirty-day Confidence Period shall be automatically demoted one rank for each attempted Coup Election call.

Subsection 2

There will be a period of maximum four hours for deliberation, where officers are able to speak freely on their positions for the election.

For a Coup Election to succeed and remove the Commander, a unanimous vote of thumbs up in favor of removal must be reached, comprised of all Officers who have communicated in FAT within the last thirty days excluding the Commander.

Subsection 3

Should a Coup Election succeed, the Commander will be removed from office, and demoted to Private. The next highest ranked officer will hold temporary power as Interim Commander who’s sole job is to oversee the election.

The election will be held via ranked choice vote amongst all remaining Officers. Anyone can be put up for election, Officer or otherwise, but Officers will be the ones who vote. Ballots will be submitted within an additional twenty-four-hour period. Then will be publicly tallied up, and results presented.

When there is a definitive winner of the election via Ranked Choice Voting, this person will be immediately installed as Commander of the Republic, the Interim Commander will step down.

Subsection 4

Following a successful Coup Election, there shall not be a call for a Coup Election for a Confidence Period of at least ninety days. Any officer who calls for a Coup Election prior to the expiry of this ninety day Confidence Period shall be demoted one rank for each attempted Coup Election call.

Article 7

The Commander of the Republic has the right to grant pardons.

Section III - The Council

Article 8

The Council shall determine and conduct the duties and policies of the Republic.

The Council shall be comprised of all Fatizens who have reached the status of Officer.

A person’s term in the Council shall be limited by nothing beside their Officer status.

A person shall immediately be granted all powers that come with sitting in the Council upon promotion to an Officer rank, and shall immediately lose all power that comes with sitting in the Council upon demotion out of the ranks of an Officer.

The Council shall have at its disposal the power of El Fatador.

The Commander shall direct the operation of the Republic, but may delegate certain aspects of his powers to the Council.

Section IV - Dictatorship

Article 9

In time of extraordinary crisis, where it is clear that the Commander and Council are too rigid a structure to handle the task at hand. A dictator may be nominated and subsequently appointed should assent be given and reign for a period of no longer than one week.

Article 10

Any Fatizen outside the rank of Private may be nominated to hold Dictatorial power.

Nominations will be put forth by the Commander or any member of the Council.

Assent to the dictatorial appointment will require three-fourths agreement from a vote comprised of the Commander of the Republic and the Council.

During the Dictators reign, they shall be provided all powers of the Republic with which to direct an immediate solution to the crisis at hand.

Article 11

Should during the Dictators reign, it becomes required to force the Dictator to relinquish their powers in advance of their one-week term, the Officers and Commander who were present to appoint the Dictator, regardless of their status at the current time, may hold another vote, requiring a two-thirds agreement to force the Dictator to step down.

With a two-thirds agreement, the Dictator will be immediately stripped of powers and the normal rule of law will resume in accordance with the FATstituion.

Section V - On Treaties and International Agreements

Article 12

The Commander of the Republic and Council shall jointly negotiate and ratify treaties.

He shall be informed of any negotiations of an international agreement.

Peace treaties, commercial treaties, treaties or agreements relating to international organization, exchange or addition of territory shall not take effect until they have been ratified by a majority of the Council and the formal assent of the Commander.

Article 13

The Republic does not recognize the jurisdiction of the International Criminal Court.

The Republic respects and follows no laws other than its own.

Section VI - On the Future of the FATstitution

Article 14

The Commander, or Officers of the Council alike, shall have the right to initiate an amendment to the FATstitution.

A Commander or Officer’s bill to amend the FATstitution shall be passed by two-thirds of the Council and Commander and shall be ratified by an additional two-thirds majority of all non-Officer Fatizens outside the rank of Private.

Shall both the Council plus Commander and the group of Non-Officer Fatizens outside the Rank of Private each give a two-third agreement to ratify an amendment, it shall be immediately written into law and appended to the Amendments.

A new amendment shall be assigned the next numerical value following the Amendment directly preceding it.

Article 15

No amendment procedure shall be commenced or continued where the integrity of the territory is jeopardized.

The Republican form of FAT shall not be the object of an amendment.

Section VII - On Fart Court Authority

Article 16

The Commander of the Republic shall guarantee the independence of the Fart Court.

He shall be assisted by the Low Court of Faticiary.

Article 17

No one shall be arbitrarily detained.

The accused must give instant obedience; resistance to the Fart Court makes him guilty.

Section VIII - The Low Court of Faticiary

Article 18

A Low Court of Faticiary shall be established.

It shall be composed of all Fatizens less the Commander, who shall hold an equal vote in all cases held within Fart Court.

The decisions in Fart Court shall be determined concluded after an unspecified time after a reasonable number of votes have been compiled and counted.

Section IX - Criminal Punishments

Article 19

All Fatizens have the right to contesting accusations in Fart Court. All Fatizens have the right to an attorney or self-representation should they so choose.

Article 20

From the formation of FAT the Republic has stood fastly against Terrorism in all its forms and methods.

A list of all known terrorists to the Republic shall be maintained publicly at all times.

Fatizens who have been accused of committing or participating in Terrorism shall be tried in Fart Court for their crimes and duly punished.

Article 21

The punishments handed down from Fart Court are not restricted by anything beyond the Law of the Republic. These punishments include but are not limited to Demotion, Derogatory Medals, Curtailed Capabilities, Mutes, Timeouts, Kicks and Bans.

Section X - The Use of El Fatador

Article 22

The right to use El Fatador is a right that no one can be deprived thereof, unless it is of public necessity, legally noted, and evidently requires it.

Article 23

Should it become a matter of public necessity, the process of restriction or total deprivation to access El Fatador will be determined and carried out by Fart Court.

Section XI - Medals, Awards and Commendations

Article 24

The Commander of the Republic and Officers alone have capabilities to award Medals to members of FAT.

Medals should be awarded for those acts that clearly and freely deserve them.

Article 25

Specific medals, including but not limited to Slowpoke, Definitely Crying and Nerdboy, can only be awarded upon a moment reaching a certain elsewhere defined number of reactions.

In most cases, medals that require a certain threshold will be automatically awarded by El Fatador, however occasionally should this fail, they can and are expected to be manually awarded by the Commander or an Officer.

Certain dispensation for awarding these medals can be taken by the Commander in cases where someone has attempted to dodge the auto awarding of the medal by deletion, editing or another similar method.

Amendments

1st Amendment

Note: A portion of Preamble, Article 1, of the FATstitution is superseded by the 1st Amendment.

2nd Amendment

The following crimes shall be met with the harshest possible sentence that is available to the Commander, the Council and Fart Court — permanent expulsion from FAT.

3rd Amendment

4th Amendment

The Commander of the Republic has the right to appoint a Vice Commander. The Vice Commander is an Officer with special emergency powers.

Whenever the Commander transmits to the Council his written declaration that he is unable to discharge the powers and duties of his office, such powers and duties shall be discharged by the Vice Commander as Acting Commander.

The Vice Commander will also act as Acting Commander in the case that the Commander has the status of debtor.

The Acting Commander shall be given all powers and duties of the Commander.

The Acting Commander will be discharged whenever the Commander has declared himself able again to assume his powers and is not a debtor.

The Vice Commander can be dismissed at the Commander’s pleasure. They will retain their status as Officer unless the Commander or Council deems a demotion to a non-officer rank necessary.
